By using the Site, downloading any extension or plugin, or subscribing to any of our services, you agree to these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

1. Definitions

In these Terms:

  • Customer / you: any individual or legal entity ordering a product or service from us via the Site.
  • Consumer: a natural person acting for purposes outside their trade, business, craft, or profession, as defined under EU law.
  • Business customer: any Customer who is not a Consumer.
  • Content: all text, graphics, logos, images, code, and other material featured on the Site or within the Services.

  • Services: any product or service offered by us, including extensions, plugins, hosting, web development, and design.
  • Charges: the fees payable for the Services as specified at checkout or in a separate invoice.

2. Free extensions and plugins

Free Joomla extensions and WordPress plugins are released under the GNU General Public License version 2 or later (GPL-2.0+). Use, modification, and redistribution are governed by the terms of that licence.

Free extensions and plugins are provided as-is, without warranty. We make reasonable efforts to keep them working with current Joomla and WordPress versions, but we cannot guarantee compatibility with every hosting environment or third-party extension or plugin.

3. Pro subscriptions

3.1 What you get

A Pro subscription gives you access to Pro-only releases for the subscribed extension or plugin, authenticated automatic updates via the Joomla Update Manager or WordPress update mechanism, and priority support, for the duration of your subscription.

3.2 Renewal

Subscriptions renew automatically at the end of each billing period. You will receive a reminder email before renewal. You may cancel at any time through your account page or by contacting us. Cancellation takes effect at the end of the current billing period and you will not be charged again.

3.3 Licence keys

A licence key is issued when your subscription is activated. It is personal and non-transferable. Do not share your licence key publicly. If your key is compromised, contact us and we will reissue it.

4. Hosting, web development, and design services

4.1 Scope

When we provide hosting, web development, design or managed server Services, a separate written quote, order form or statement of work sets out the scope, deliverables and timeline. These Terms apply in addition to that document.

4.2 Resource allocation

For hosting and managed server services, you agree not to exceed the bandwidth, storage, or memory allocations specified in your plan. If your usage threatens system stability, FunFex LTD reserves the right to temporarily suspend the affected Service to protect our network and other customers, after reasonable notice where practicable.

4.3 IP addresses

Any IP address allocated to you remains the property of FunFex LTD or its upstream providers. It is assigned to you as part of the Service and is not portable or transferable. Upon termination, you have no right, title, or interest in any IP address previously allocated to you.

4.4 Customer content

You retain all intellectual property rights in the content you upload to our servers or supply for use in our Services. You grant FunFex LTD a royalty-free, worldwide, non-exclusive licence to host, store, process, and back up that content solely to the extent necessary to provide the contracted Services. You warrant that your content does not infringe any third-party rights, violate any applicable law, or contain malicious code.

5. Charges, payment, and late payment

5.1 General

All Charges are billed in euros (EUR) unless explicitly designated otherwise at checkout. Prices are exclusive of VAT unless stated otherwise. VAT is applied at checkout in accordance with EU VAT rules and your country of residence. Payments are processed securely by third-party providers (e.g., Stripe, Freemius). We do not store your card details.

5.2 Failed renewals

If an automated renewal payment fails, we will notify you by email. Access to Pro releases, hosting, or managed services may be suspended until payment is resolved. The payment processor will retry the payment automatically for a short period.

5.3 Late payment (business customers)

Where the Customer is a Business customer, overdue invoices may attract statutory late payment interest and reasonable recovery costs in accordance with Directive 2011/7/EU on combating late payment in commercial transactions, as transposed into Bulgarian law (in particular the Commerce Act and the Obligations and Contracts Act), following written notice and a reasonable period to cure.

6. Right of withdrawal (EU consumers)

Under Directive 2011/83/EU on consumer rights, Consumers in the European Union have the right to withdraw from a distance contract within 14 days without giving any reason.

6.1 Digital content (extensions, plugins, licence keys)

By purchasing a Pro subscription or other digital content and downloading or activating it before the end of the 14-day withdrawal period, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal in accordance with Article 16(m) of the Directive.

If you have not yet downloaded or activated any Pro release, you may request a refund within 14 days of purchase by contacting us at This email address is being protected from spambots. You need JavaScript enabled to view it..

  • Host, distribute, or transmit illegal material, defamatory content, or unsolicited bulk communications.
  • Use automated tools to scrape or overload the Site.

9. Intellectual property

Free extensions and plugins are GPL-licensed: their source code is yours to use and modify within the terms of that licence. Pro extension and plugin code, documentation, and all other site content remain the property of FunFex LTD. Nothing in these Terms transfers ownership of any intellectual property to you.

10. Data protection

We process personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and applicable national data protection laws. For details on what data we collect, how we process it, and your rights as a data subject, see our Privacy Policy.

Where Pro extensions or plugins transmit technical information back to our servers for licence validation, compatibility verification, and product improvement (for example: domain name, software version, PHP version, Joomla or WordPress version), such processing is carried out on the legal basis of performance of a contract (Article 6(1)(b) GDPR) and our legitimate interest in protecting our licensed software (Article 6(1)(f) GDPR).

10.1 Data retention exception

Notwithstanding any request for deletion, we retain invoicing, accounting, and tax-related records for the period required by Bulgarian law, including the Accountancy Act and the Tax-Insurance Procedure Code, which currently requires retention of accounting documents for up to 10 years.

11. Limitation of liability

11.1 General

To the maximum extent permitted by law, FunFex LTD shall not be liable for any indirect, incidental, special, or consequential loss, including but not limited to loss of profits, data, goodwill, or business interruption, arising from your use of, or inability to use, the Site or any Service.

11.2 Exclusions from limitation

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • gross negligence or wilful misconduct;
  • any liability that cannot be limited or excluded under applicable Bulgarian or EU law, including statutory rights granted to Consumers under Directive (EU) 2019/770, Directive (EU) 2019/771, and their Bulgarian transpositions.

12. Term and termination

You may terminate your account or cancel recurring Services at any time via your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your access to the Services immediately if you materially breach these Terms and fail to remedy the breach within 14 days of written notice, or in the case of non-payment, in accordance with clause 5.

Upon definitive termination, your Content stored on our servers will be permanently deleted within 60 days, except for data we are required to retain under clause 10.1.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email to registered users at least 30 days before they take effect. Continued use of the Site or Services after changes take effect constitutes acceptance of the new Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of Bulgaria, without prejudice to the mandatory consumer protection provisions of the country in which a Consumer habitually resides, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).

For Business customers, any disputes shall be subject to the exclusive jurisdiction of the courts of Bulgaria. For Consumers, claims may also be brought in the courts of the Consumer's country of residence under Regulation (EU) No 1215/2012 (Brussels I recast).
