This policy applies to software, code, documentation, extensions, plugins, scripts, integrations, digital assets, and other deliverables made available through funfex.com or provided directly by FunFex LTD, unless a separate written agreement states otherwise.
1. Custom client projects
The source code and intellectual property rights in custom-built deliverables developed by FunFex LTD for a client belong to the client after full payment has been received, in accordance with the Bulgarian Copyright and Neighbouring Rights Act (Закон за авторското право и сродните му права) and applicable EU legislation, unless a separate written agreement provides otherwise.
The client may decide whether to:
- keep the source code private for internal business use;
- modify, extend, or maintain the source code independently;
- transfer the project to another developer or technical team;
- publish or release the project as open-source software;
- use the software commercially within their own business operations.
FunFex LTD does not claim ownership over client-specific business logic, private data, confidential materials, branding, designs, content, or specifications supplied by the client.
2. FunFex pre-existing materials
FunFex LTD may use pre-existing internal tools, reusable components, templates, libraries, frameworks, scripts, configuration patterns, development methods, and know-how when delivering a project.
Unless expressly transferred in writing, these pre-existing materials remain the property of FunFex LTD. Where they are included in a client project, the client receives a perpetual, worldwide, non-exclusive license to use them as part of the delivered solution. This license permits the client to operate, maintain, modify, and extend the delivered project, but does not transfer ownership of FunFex LTD's general-purpose tools, methods, reusable code, or internal development assets.
3. Free extensions
All free FunFex extensions and tools are open-source software released under the GNU General Public License version 2 or later (GPL-2.0+), unless a different open-source license is explicitly stated for a specific item.
You are free to use, modify, and redistribute free FunFex extensions in accordance with the terms of the applicable license. The source code for every free extension is included in the install package.
4. Pro extensions and subscriptions
Pro releases, premium extensions, and subscription-based products are commercial proprietary software. Access requires an active subscription purchased through funfex.com.
A valid subscription grants the customer a limited, personal, non-exclusive, non-transferable commercial license to:
- download and install the software on websites, systems, or projects owned or administered by the customer;
- receive authenticated automatic updates via the native update mechanism (Joomla Update Manager, WordPress automatic updates, or equivalent) during the active subscription period;
- access support during the active support period, where support is included.
Pro releases may not be:
- resold, redistributed, sublicensed, or shared publicly;
- uploaded to public repositories or made available for download by third parties;
- used to create a competing product based substantially on the original software.
Pro subscription licenses are not GPL.
5. License keys and access credentials
License keys, access tokens, account logins, and API keys are issued to the customer and must be kept confidential. They may not be shared publicly, sold, transferred, or used to provide unauthorised access to paid software, updates, or services.
FunFex LTD may suspend or revoke access if a license key is misused, shared publicly, obtained fraudulently, or used in violation of this policy.
6. Subscription expiry
If a subscription expires, the customer may continue using the latest version downloaded during the active subscription period on the sites where it was installed, unless the specific product terms state otherwise. After expiry, the customer will no longer receive new releases, security updates, feature updates, authenticated downloads, technical support, or access to subscriber-only resources. Renewing the subscription restores access to updates and support from the renewal date.
7. Third-party libraries
Some FunFex software bundles third-party libraries. All bundled libraries are licensed under terms compatible with the primary license of the product, including:
- LGPL-2.1 or later (GNU Lesser General Public License)
- MIT (MIT License)
- Apache-2.0 (Apache License 2.0)
- BSD (2-clause and 3-clause)
- Public Domain
Extensions that include third-party libraries ship with a LICENSES-third-party.txt file listing each library, its version, author, license, and project URL. Customers and users remain responsible for complying with applicable third-party license terms.
8. Client-provided materials
The client remains responsible for any materials, assets, data, content, software, images, text, trademarks, credentials, or third-party resources supplied to FunFex LTD. By providing such materials, the client confirms that they have the necessary rights, licenses, permissions, or authorisations to use them in the project. FunFex LTD is not responsible for intellectual property claims arising from materials supplied by the client.
9. Portfolio use
Unless agreed otherwise in writing, FunFex LTD may refer to completed projects in its portfolio, case studies, marketing materials, and website. FunFex LTD will not disclose confidential information, private source code, security-sensitive details, trade secrets, credentials, internal documentation, or non-public business information without permission. Clients may request confidentiality or restricted portfolio use in writing.
10. General restrictions
Unless expressly allowed by the applicable license or written agreement, users may not:
- copy, resell, or redistribute proprietary software;
- remove copyright, license, or attribution notices;
- share paid products with unauthorised third parties;
- publish private source code without permission;
- use FunFex LTD software for unlawful purposes;
- attempt to bypass license verification, access control, or subscription restrictions;
- claim ownership of FunFex LTD proprietary materials;
- use FunFex LTD trademarks, branding, or identity without permission.
11. Right of withdrawal (consumers in the EU)
In accordance with Directive 2011/83/EU on consumer rights, as transposed into Bulgarian law by the Закон за защита на потребителите (Consumer Protection Act), consumers established in the European Union have a 14-day right of withdrawal from the date of purchase of digital content.
By purchasing and downloading a Pro release or activating a license key, you expressly consent to the immediate supply of digital content and acknowledge that you thereby waive your right of withdrawal once the download has begun, in line with Article 16(m) of Directive 2011/83/EU. This waiver does not apply to subscriptions that have been paid for but where no download has yet taken place.
12. Warranty disclaimer
Software and digital materials are provided with reasonable professional care, but without any commercial warranty that they will be error-free, uninterrupted, compatible with every hosting environment or third-party service, or suitable for every specific purpose.
To the maximum extent permitted by applicable law, FunFex LTD disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in this policy excludes or limits any statutory rights and legal guarantees you may have as a consumer under mandatory provisions of the Bulgarian Consumer Protection Act, Directive (EU) 2019/770 on contracts for the supply of digital content and digital services, or the consumer protection law of your country of residence within the EU.
13. Limitation of liability
To the maximum extent permitted by applicable law, FunFex LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenues, data, business opportunities, service interruption, or security incidents caused by third parties.
Where liability cannot be excluded, FunFex LTD's total aggregate liability arising out of or in connection with a specific product or service shall be limited to the amount paid by the customer for that product or service in the twelve (12) months preceding the event giving rise to the claim.
For consumers, these limitations do not affect liability for death, personal injury, gross negligence, wilful misconduct, or any other liability that cannot be limited or excluded under mandatory provisions of EU or Bulgarian law.
14. Data protection
Processing of personal data in connection with the purchase, activation, and renewal of licenses is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and the Bulgarian Personal Data Protection Act. Details are provided in the FunFex Privacy Policy published on funfex.com.
15. Governing law and jurisdiction
This License Policy is governed by the laws of the Republic of Bulgaria and applicable European Union law. Any dispute arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the competent courts in Sofia, Bulgaria.
For consumers domiciled in the European Union, this clause is without prejudice to the right to bring proceedings before, or to be sued in, the courts of the consumer's country of residence, in accordance with Regulation (EU) No 1215/2012 (Brussels I recast).
Consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to settle disputes out of court.
